1. Acceptance of Terms

By accessing and using The Marketing Machine website and services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to any part of these terms, you must not use our services.

2. Services

The Marketing Machine provides a suite of business tools including CRM, automation, content creation, video studio, video rooms, project management, AI employees, LinkedIn lead generation, and website building. The specific services available to you depend on the plan you subscribe to. We reserve the right to modify, suspend, or discontinue any service at any time, with reasonable notice where possible.

3. Subscriptions and Billing

Subscription plans are billed on a monthly or annual basis as selected at checkout. All payments are processed securely through Elite Marketing. Prices are stated in GBP unless otherwise indicated. You authorise us to charge your chosen payment method for the full amount of your subscription until you cancel. You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

4. Free Trials

Where a free trial is offered, it allows you to evaluate the service before committing to a paid plan. Trial duration is stated at the point of sign-up. At the end of the trial period, your selected paid plan begins automatically unless you cancel before the trial ends. Usage charges for texts and emails may apply during the trial.

5. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. You must be at least 18 years old to use our services.

6. Acceptable Use

You agree not to use our services for any unlawful purpose, to send unsolicited communications or spam, to infringe the rights of any third party, to upload or transmit viruses or malicious code, or to attempt to gain unauthorised access to our systems or data. We reserve the right to suspend or terminate accounts that breach these terms.

7. AI Employees and Bring Your Own Key

The AI Employees product runs on your own AI provider key. You are responsible for the costs of your AI usage billed directly by your chosen provider. We add no markup to your AI usage. You are responsible for setting budgets and spending caps with your provider and within the HQ dashboard. We are not liable for AI provider charges.

8. Content and Intellectual Property

You retain ownership of all content you create using our services. By uploading content, you grant us a limited licence to host, store, and process that content as necessary to provide the service to you. You must have the rights to any content you upload. The Marketing Machine name, logo, and platform design remain our intellectual property.

9. Third-Party Services

Our services may integrate with or connect to third-party tools and platforms. We are not responsible for the availability, accuracy, or practices of these third parties. You are subject to their terms when using their services.

10. Elite Software Deals

Elite Software Deals are exclusive discounts negotiated with third-party providers. Offers rotate regularly and availability is subject to change. We do not guarantee that any specific deal will remain available. Deals are provided by the third party and are subject to their terms.

11. Limitation of Liability

Our services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim is limited to the amount you paid us in the three months preceding the claim.

12. Changes to These Terms

We may update these Terms and Conditions from time to time. We will notify you of material changes by email or through the platform. Continued use of our services after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
